GENERAL TERMS AND CONDITIONS OF SALE

  1. PURPOSE

These General Terms and Conditions of Sale (hereinafter, "General Terms"), together with any specific conditions applicable to certain products or offers, regulate purchases made by users ("Users") through the online store accessible at http://aristopet.com/aristoshop/ (hereinafter, the "ARISTOSHOP"). These General Terms will be incorporated into your purchase agreement (hereinafter, the "Agreement") when you click the "Pay" button or equivalent during the electronic purchase process.

PROVISION&APPAREL, S.L. (hereinafter, "ARISTOPET"), with registered office at Calle Monte Albillo 15 – 28110 Algete, Madrid and Tax Identification Number B-87418075, is the seller of the items offered through ARISTOSHOP, so the Agreement is formalized between this company and ARISTOSHOP Users.

  1. USER REGISTRATION

To facilitate online purchases and avoid asking Users for the same data every time they make a new purchase, they can register as a User in ARISTOSHOP. Such User registration can be done in two ways:

  1. During the User's purchase process, by clicking on "Create an account?", after entering the requested billing information and the account password.

  1. Before making any purchase, by clicking on the "ME" section of the ARISTOPET website, and completing the registration details (email and password).

At the end of the registration process, you will receive an email confirming your registration as a User in ARISTOSHOP. You can access your registered user account with your email address and password by clicking on "Already a customer? Click here to log in" at the top of the page.

Through the User account, you can complete shipping and billing details, track your orders, view and edit your personal data, and carry out any other procedures and arrangements that may be available at any time.

To purchase from ARISTOSHOP, you must be over 18 years of age, and Users who register guarantee that they meet this condition. Registered Users will be obliged to make diligent use of and keep their passwords or other credentials secret. Consequently, Users are responsible for the proper custody and confidentiality of any identifiers and/or passwords provided to them by ARISTOPET, and undertake not to transfer their use to third parties, whether temporarily or permanently, nor to allow access to unauthorized persons. The User will be responsible for the use of the services by any illegitimate third party who uses a password for this purpose due to negligent use or loss of the same by the User.

By virtue of the foregoing, the User is obliged to immediately notify ARISTOPET of any event that allows the improper use of identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed with their immediate cancellation. Until such events are communicated, ARISTOPET will be exempt from any liability that may arise from the improper use of identifiers or passwords by unauthorized third parties.

The passwords or other credentials used by the registered User in ARISTOSHOP will be considered an advanced electronic signature for the purposes of the provisions of article 3.10 of Law 59/2003, of December 19, on Electronic Signature.

Registration as a User of ARISTOSHOP is free. You can unsubscribe as a registered User by sending an email to the following address: hola@aristopet.com Unsubscribing as a registered User will entail the cancellation of the personal data associated with your Account.

  1. GEOGRAPHICAL SCOPE OF ARISTOSHOP

Sales through ARISTOSHOP are limited to mainland Spain and the Balearic Islands. (However, the cost of this shipment may vary depending on the weight and volume of the package). Consequently, the sale and delivery of products to the Canary Islands, Ceuta and Melilla or any other place not included in the aforementioned territorial scope is EXPRESSLY EXCLUDED from ARISTOSHOP.

  1. PURCHASE PROCESS

The purchase process consists of the following steps:

  • Product selection: browse the different sections of ARISTOSHOP and click the "Add to Cart" button or on the product name to obtain more specific information about the product, such as a brief description, color, dimensions, unit price (VAT included) and estimated delivery date. Each time you wish to add a product to your shopping cart, click the "Add to Cart" button.
  • Initiate the purchase process: once you have clicked the "Add to Cart" button on the selected product page, you can go to the shopping cart, where you will see the information about your order for your review, which will include the name of the selected products, the unit price, the quantity of units selected for each product, the subtotal price for the products based on that quantity, and the total price of the order, breaking down the amounts corresponding to the applicable VAT. At that time, the User can modify the quantity of units selected for each product, edit any of the products, or remove any product from the order.
  • Once the order information has been reviewed, the User must click the "Proceed to Checkout" button to continue with the purchase process. Next, the User must fill in the requested billing and shipping information, as well as, optionally, specific notes about the product order (e.g., special shipping instructions, etc.). If registered as a User, they can log in by clicking on "Already a customer? Click here to log in" and entering their username or email and password. In this way, the shipping and billing details previously entered will be displayed, which can be confirmed or modified by the User.
  • Donations: before completing the purchase process, the User has the option to select an animal shelter from those offered in the drop-down menu in the "Donations" section, which will receive a donation equivalent to 1% of the total amount of the User's purchase. The donation is made by ARISTOPET on its own behalf and does not involve any additional charge to the User's purchase.
  • Completion of the purchase process: to complete the purchase process, Users must select the chosen payment method and provide the necessary data (e.g., card number, etc.). If the User completes the purchase by clicking the "Pay" button, from that moment on they will be obliged to pay for the order and the Contract will be perfected for all purposes. The User must obligatorily accept these General Conditions and our Privacy Policy by checking the corresponding box.
  • Purchase confirmation: once we receive your acceptance, ARISTOSHOP will display an on-screen confirmation of the order placed containing the following information:
  • Order number.
  • Summary of the products included in the order.
  • Order delivery date.
  • Total order price, breaking down shipping costs if applicable.

Likewise, ARISTOSHOP will send a purchase confirmation by email with the details of the same, including the estimated delivery date of the order, as well as a copy of these General Conditions.

Once the purchase process is completed, the User cannot modify or cancel the order except in the cases provided by law or in these General Conditions.

  1. PRODUCT AVAILABILITY

ARISTOPET does not guarantee the availability of products offered through ARISTOSHOP. If, after placing the order, we detect that any of the products included in it are out of stock, we will contact the User to inform them of the impossibility of supplying that item and will proceed to refund the corresponding amount. The foregoing is without prejudice to the legal rights that may correspond to you as a consumer.

  1. OFFERS

Without prejudice to the provisions of specific legislation, discounts or other types of offers will be valid for the period of time and/or for the number of units specified in ARISTOSHOP or, failing that, for as long as they remain published therein.

Discounts or other types of offers may be subject to specific conditions that may be established. These specific conditions will form part of the Contract.

  1. PRICES AND SHIPPING COSTS

All prices shown in ARISTOSHOP are expressed in euros and include taxes.

Before finalizing the purchase process, the User will be able to know the complete final price of their order, broken down, if applicable, the amount of any increases or discounts applied, as well as transportation costs or other additional services. This applies to shipments in Peninsula.

The shipping costs applicable to orders are 8.50 euros per order and will be borne entirely by the customer. However, if it is an island shipment, shipping costs may increase, and the customer will be informed accordingly.

The shipping amount could exceptionally vary considering the volume or weight of the order. If the weight exceeds 15 kilos, the shipping price will be quoted according to what the transport company indicates (feed, cat litter, cat scratchers, etc.)

Eventually, ARISTOSHOP may offer promotions through which shipping is offered at no additional cost to the User. In these cases, the enjoyment of this benefit will be conditioned on compliance with the terms of the promotion in question.

Despite the measures adopted by ARISTOPET to avoid errors, it may happen that the price of a product applied during the purchase, or its shipping costs, are not those offered or that the offered price displayed on ARISTOSHOP was erroneous. In the event that such errors are detected after the formalization of the Contract, said Contract will be void in accordance with current legislation and without prejudice to your rights as a consumer. ARISTOPET will notify you of such incident as soon as it becomes aware of it and, in the event that you have been charged any amount for said purchase, it will proceed to refund it.

  1. PAYMENT

Payment is made when the User completes the electronic purchase process by clicking the "Pay" button. The User may pay the price of the orders by any of the following means:

  • By selecting the Banco Sabadell Virtual POS platform, using debit or credit cards issued by financial institutions of the following types:
  • Visa
  • MasterCard
  • PayPal System.
  • Bank Transfer.

Payment for your order occurs in real time once the issuing entity has communicated to ARISTOPET the payment authorization. Otherwise, the User will not be able to continue the purchase process. ARISTOPET is unrelated to the payment authorization, so the User must contact the issuing entity directly in case of any incident regarding said authorization.

The use of a third-party payment method is prohibited, except with the express authorization of said third party, with the User being responsible for proving such authorization and assuming all damages that may occur to ARISTOPET.

  1. INVOICE

ARISTOPET will issue and send Users by email the complete invoices corresponding to the orders placed. For these purposes, the User expressly consents to the issuance of electronic invoices. However, Users who wish to receive their invoice on paper may request it through our Customer Service.

  1. DELIVERY

During the purchase process, the User must provide the delivery address or, in the case of registered Users, confirm the default address or modify it.

ARISTOPET does not accept post office boxes or addresses outside the territorial scope of ARISTOSHOP as defined in these General Terms and Conditions as valid shipping addresses.

Delivery times will depend on the selected product and will be shown in the detailed information for each product. If an order consists of several products, the order information displayed during the purchase process will show the estimated delivery date corresponding to the product with the longest delivery time.

In any case, for the purposes of the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, "Consolidated Text of the General Law for the Defense of Consumers and Users"), it shall be understood that the delivery date committed by ARISTOPET is the estimated delivery date shown in the order information displayed to the User during the purchase process.

Orders will be shipped through transport companies.

Delivery occurs when the User or an authorized third party receives the order at the designated shipping address. The recipient must sign the delivery note or document justifying the delivery of the order. It will be understood that any third party who receives the order at the address indicated by the User for shipment and signs the delivery note or equivalent document, is authorized by the User to receive the order on their behalf. Consequently, ARISTOPET does not accept any liability to the User for receipt by another person on their behalf without due authorization, provided that such receipt is made at the delivery address indicated by the User.

The signing of the delivery note does not imply conformity and only serves to prove that delivery has taken place. It therefore does not affect your contractual rights or imply conformity with a faulty product. Without prejudice to your contractual and legal rights, we ask that, in order to process any incident related to the shipment of the goods, you notify us, through our Customer Service, within a period not exceeding 24 hours of any incident related to the shipment, except for defects or flaws.

The delivery of the products entails the transmission to the User of the risk of loss or deterioration of the products and, consequently, ARISTOPET will not be liable for said risks from said delivery.

In the event that delivery is not possible, ARISTOPET will reimburse the full amount of the order, at which point the Contract will be terminated due to impossibility of fulfillment and without prejudice to any claims that ARISTOPET may initiate in case of intent or fault of the User.

  1. RIGHT OF WITHDRAWAL

The User has the right to withdraw from this contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by the User, other than the carrier, acquired material possession of the goods. In the case of delivery of multiple goods ordered by the User in the same order and delivered separately, the withdrawal period will expire 14 calendar days from the day on which the User or a third party indicated by the User, other than the carrier, acquired material possession of the last of those goods.

To exercise the right of withdrawal, you must notify ARISTOPET of your decision to withdraw from the contract through an unequivocal statement sent through one of the channels indicated below. You may use the withdrawal form template included in the Annex to these General Terms, although its use is not mandatory. To exercise the aforementioned right, you can use the following channels:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

In case of withdrawal by you, we will reimburse the User all payments received from him, including delivery costs, with the exception of additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method we offer, without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make said reimbursement using the same payment method used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any expense as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back, or you have supplied evidence of having sent back the goods, whichever is the earliest.

If the User has received the goods, they must return or deliver the goods directly to PROVISION&APPAREL , S.L. C/Monte Albillo, 15 28110-Algete, Madrid, without undue delay and, in any case, no later than 14 calendar days from the date on which they communicate their decision to withdraw from the contract. The deadline will be considered met if the goods are returned before said period has expired.

You will have to bear the direct cost of returning the goods. It is estimated that this cost will not generally exceed the price of the purchased product, although depending on the volume, the address from which it is sent, and the price of the product, particularly when it comes to low-priced products, the return cost could exceed said price.

The User will only be responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

 

  1. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the Revised Text of the Consumer and User Law, the right of withdrawal will not apply to contracts that refer to:

  1. a) The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully executed by the entrepreneur, they will have lost their right of withdrawal.
  2. b) The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
  3. c) The supply of goods manufactured according to the specifications of the consumer and user or clearly personalized.
  4. d) The supply of goods that may deteriorate or expire rapidly.
  5. e) The supply of sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery. The right of withdrawal also excludes products considered as pet beds.
  6. f) The supply of goods that, after their delivery and taking into account their nature, have been inextricably mixed with other goods.
  7. g) The supply of alcoholic beverages whose price has been agreed upon at the time of concluding the sales contract and that cannot be delivered before 30 days, and whose real value depends on market fluctuations that the entrepreneur cannot control.
  8. h) Contracts in which the consumer and user have specifically requested the entrepreneur to visit them to carry out urgent repair or maintenance operations; if, during that visit, the entrepreneur provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out the maintenance or repair operations, the right of withdrawal must apply to said additional services or goods.

 

  1. i) The supply of sealed audio or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.
  2. j) The supply of daily newspapers, periodicals, or magazines, with the exception of subscription contracts for the supply of such publications.
  3. k) The supply of accommodation services for purposes other than housing, transport of goods, vehicle rental, food, or services related to leisure activities, if the contracts provide for a specific date or period of execution.
  4. l) The supply of digital content not supplied on a tangible medium if the performance has begun with the consumer’s and user’s prior express consent and their acknowledgment that they thereby lose their right of withdrawal.

 

  1. PRODUCT WARRANTY

Products purchased through ARISTOSHOP are guaranteed against any lack of conformity existing at the time of delivery under the terms provided in the Revised Text of the General Law for the Defense of Consumers and Users.

Thus, the User will have the right to repair the product, replace it, reduce the price, or terminate the Contract within two (2) years from the delivery of the product under the conditions established by said legislation.

The User may communicate any lack of conformity of any product sold through ARISTOPET's Customer Service.

The User must keep the invoice or delivery note to enforce the product warranty.

Any additional commercial warranty offered by producers must be claimed directly by Users from them. ARISTOPET will not be responsible in any case for the non-compliance by producers with said warranties.

ARISTOPET will resolve claims addressed to it as soon as possible and, in any case, within one month. In case of complaints or claims, an email with proof of your claim will be sent to the User.

 

  1. FORCE MAJEURE OR FORTUITOUS EVENT

ARISTOPET will not be responsible for the total non-compliance, defective compliance, or delay in the compliance of any of its obligations caused by an event of force majeure or fortuitous event. Obligations subject to a deadline that may exist will be suspended in such cases for the entire period during which the situation of force majeure or fortuitous event persists, resuming the calculation once said circumstance of force majeure or fortuitous event disappears.

  1. LIABILITY

ARISTOPET will be responsible for damages caused to the User that are a consequence of the fraudulent breach of its obligations. The compensation for damages, in case of non-compliance with any obligations assumed by ARISTOPET regarding damages caused by fault or negligence, is limited to the price of the product or one hundred (100) euros, whichever is greater.

The foregoing limitation of liability will not apply in cases where it is not permitted by applicable law, such as cases of damages arising from the lack of conformity of the products or for damages, death, or injury caused to the consumer and user by an action or omission of the entrepreneur.

  1. INTEGRITY OF THE CONTRACT

These General Conditions and all documents expressly referred to therein (such as particular clauses or specific conditions established for certain products) constitute the entirety of the Contract, superseding any other agreements or covenants that the parties may have verbally or in writing agreed upon prior to the conclusion of the Contract.

  1. APPLICABLE LAW

These General Conditions are governed by Spanish law.

  1. MODIFICATION

ARISTOPET may modify these General Conditions at any time. The modifications made will not, in any case, affect purchases made by the User prior to the approval of said modifications.
