  1. Legal information and acceptance

This Legal Notice regulates the access and use of the website corresponding to the address www.aristopet.com (the "Portal") that PROVISION & APPAREL SL. (hereinafter, "ARISTOPET"), with registered office at C/ Monte Albillo, nº 15, 28110 –Algete, Madrid, telephone [900820450], email and CIF B-87418075, registered in the Mercantile Register of Madrid volume 34.016 | folio 129 | section 8, sheet M-612.151, makes available to Internet users.

The use of the Portal confers the status of user of the Portal (hereinafter, the "User") and implies acceptance of all the rules of use contained in this Legal Notice.

  1. Conditions of Use of the Portal
    • General

Users undertake to make proper use of the Portal in accordance with the Law and this Legal Notice. Users who breach the Law or this Legal Notice shall be liable to ARISTOPET or to third parties for any damages that may be caused as a consequence of the breach of said obligation.

The use of the Portal for purposes that are harmful to the assets or interests of ARISTOPET or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of ARISTOPET or third parties is expressly prohibited.

  • Insertion of links to the Portal

Users or providers of Information Society Services who wish to insert links from their own websites to this Portal must comply with the conditions detailed below:

  • No false, inaccurate or incorrect statement will be made from the page that inserts the link about ARISTOPET, its partners, employees, members or about the quality of the services it offers.
  • Under no circumstances will it be stated on the page where the link is located that ARISTOPET has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises the services of the sender or supports the ideas, statements or expressions included on the sender's page.
  • The use of any denominative, graphic or mixed brand or any other distinctive sign of ARISTOPET is prohibited except in cases permitted by law or expressly authorized by ARISTOPET and provided that, in these cases, a direct link to the Portal is permitted in the manner established in this clause.
  • The link will only link to the home page or main page of the Portal, without reproducing the Portal or its content, and it is in any case prohibited to establish frames or frames or otherwise allow the viewing of the Portal or its contents through an internet address other than those of the Portal.
  • The page that establishes the link must faithfully comply with the Law and may not in any case provide or link to its own or third-party content that is illicit, or that is inappropriate in relation to ARISTOPET's activity.
  • Intellectual and industrial property

The Portal, including its graphic design, as well as its contents, meaning for illustrative purposes only texts, photographs, graphics, images, software and other content, are the intellectual property of ARISTOPET or of third parties that have licensed it to ARISTOPET, without any of the exploitation rights recognized by current intellectual property regulations being understood to be assigned to Users. In particular, Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the contents except to the extent necessary for browsing the Portal, in cases authorized by law or when expressly consented to by ARISTOPET.

The brands, trade names or distinctive signs are the property of ARISTOPET, and it cannot be understood that access to the Portal attributes to Users any right over the aforementioned brands, trade names and/or distinctive signs.

  1. Exclusion of liability
    • Of the availability of the service

ARISTOPET tries to keep the Portal operational and error-free, but the User accepts to use the Portal under their sole responsibility. The Portal is provided as is, without any warranty, express or implied, so, unless legally required under applicable law, we do not offer warranties regarding its merchantability or fitness for a particular purpose, nor do we guarantee that access or use of the Portal will be uninterrupted or completely free of errors. Likewise, access to the Portal requires services and supplies from third parties, including transportation through telecommunications networks, whose reliability, quality, security, continuity and operation are not the responsibility of ARISTOPET nor are they under its control. ARISTOPET will not be responsible for failures or disconnections in telecommunications networks or other services provided by third parties that cause the suspension, cancellation or interruption of access to the Portal,

  • Of the content and services linked through the Portal

The Portal may include links that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, ARISTOPET acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce ("LSSI") and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the illegality and has not disabled the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, they may notify ARISTOPET in accordance with the procedure and effects established in clause 5 of this Legal Notice, without this communication in any case implying the obligation to remove the corresponding link.

In no case shall the existence of Linked Sites imply the existence of agreements with the persons responsible or owners thereof, nor the recommendation, promotion or identification of ARISTOPET with the statements, content or services provided.

  • Of third-party content hosted by ARISTOPET

The Portal includes or may include the possibility for Users or other third parties to publish comments, videos, photographs, messages, opinions, etc. In these cases, ARISTOPET acts as an intermediary hosting service provider in accordance with Article 16 of the LSSI and will only be responsible for the content published by other Users or third parties to the extent that it has actual knowledge of the illegality and has not removed the illegal content with due diligence. In the event that the User considers that there is illegal or inappropriate content, they may notify ARISTOPET in accordance with the procedure and effects established in clause 5 of this Legal Notice, without this communication in any case implying the obligation to remove the corresponding comment or content.

In no case shall the existence of third-party content imply the existence of agreements with the authors thereof, nor the recommendation, promotion or identification of ARISTOPET with the statements or information provided.

  • Security of the Portal

Connection to the Portal is made through open networks, so ARISTOPET does not control the security of data communication or of equipment connected to the Internet. It is the User's responsibility to have adequate tools for the prevention, detection and disinfection of harmful computer programs or malicious software. Information on free tools for detecting malicious software, such as viruses, Trojans, etc., can be obtained on the OSI website: http://www.osi.es/es/herramientas

ARISTOPET is not responsible for damages caused to users' computer equipment during connection to the Portal by acts of third parties, nor for the lack of security or confidentiality of information transmitted by third-party telecommunications equipment and networks or as a result of software or hardware vulnerabilities of the users' own equipment.

  1. Terms of Use of our social network (for ARISTOGANG Users only)

Access and use of the social network offered through the Portal ("ARISTOGANG") is governed by the provisions of this Legal Notice in everything applicable, as well as by the specific conditions contained in this Section.

  • In general, the User undertakes to use ARISTOGANG in strict compliance with applicable law and this Legal Notice, being solely responsible for the use that may be given to ARISTOGANG and for any consequences arising therefrom, including the obligation to hold ARISTOPET harmless for any type of damage, loss or expense caused.
  • The User is responsible for any content they publish on ARISTOGANG, understood as, but not limited to, any comment, opinion, message, information, photograph, video, audio, link, etc. (hereinafter, "Content"). ARISTOPET has no obligation to monitor or generally control the Content published by Users and accepts no responsibility for it.
  • The use or reliance that Users may place on any Content published by other Users through ARISTOGANG is the sole responsibility of the Users. ARISTOPET does not guarantee that the Content published by Users is complete, truthful, accurate or reliable, nor do we approve or endorse the Content published by Users through ARISTOGANG. The User understands and accepts that ARISTOPET acts as a mere intermediary service provider, in accordance with the LSSI, and that it will only be responsible for said Content to the extent that it has effective knowledge of its illegality and has not removed the Content with due diligence.
  • The publication of illicit, misleading, malicious or fraudulent, harmful, denigrating, discriminatory, xenophobic Content, contrary to morality or that in any way infringes the right to honor, privacy and self-image or any other fundamental right of other people is expressly prohibited.
  • In the event that the User publishes Content of any kind on ARISTOGANG, they declare and guarantee that they have the right to do so freely, that they are the author or hold the necessary rights over said Content and, consequently, that the publication thereof on ARISTOGANG does not infringe or violate intellectual or industrial property rights, trade secrets, or any other third party rights.
  • The User will not publish any Content referring to other people without first ensuring that they have their consent for such publication, nor will they annoy, intimidate or harass any other User.
  • The inclusion of Content or the sending of communications for commercial or advertising purposes is not authorized.
  • ARISTOPET reserves the right to decide on the publication of the Content sent by Users, as well as the right to delete it once published and/or deactivate their user account, at its sole discretion, for any reason and without prior notice and, in particular, when the Content may be considered illegal, prohibited or simply inappropriate.
  • The User gratuitously assigns to ARISTOPET, without exclusivity, the rights of use, reproduction, extraction, reuse, distribution, transformation and public communication, in all possible modalities, both within the Portal and in other channels (websites, media, other social networks, etc.), in relation to the Contents they publish on the Portal. The aforementioned assignment is made worldwide, for the maximum duration currently provided for in the Intellectual Property Law and with express power to assign to third parties.
  • The User is responsible for safeguarding the passwords they use to access ARISTOGANG and for any activity or act carried out with their passwords, being expressly prohibited from communicating them to any third party or from the passwords being shared by several people at once. We recommend that you protect your account with a strong password (a password that contains combinations of upper and lower case letters, numbers and symbols) and that you change it periodically. Likewise, you will notify us, as soon as possible, of any loss or theft of your credentials of which you may become aware. We will not be responsible for any harm or damage resulting from the breach of the aforementioned.
  1. Communication of illicit and inappropriate activities or services

In the event that the User or any other third party becomes aware that the Linked Sites, content or any other service provided through the Portal, are illicit, harmful, denigrating, violent or contrary to morals; or that in any other way they infringe third-party rights, you may contact ARISTOPET indicating the following details:

  • Personal data of the communicator: name, address, telephone number and email address. These data will be incorporated into a file under the responsibility of ARISTOPET with the sole purpose of attending to your request. You may exercise your rights of access, rectification, cancellation and opposition in accordance with the provisions of the Privacy Policy. The omission of any of these data may mean that your request is not attended to, without prejudice to any voluntary inquiries that ARISTOPET may wish to make.
  • Description of the facts that reveal the illicit or inappropriate nature of the service.
  • In the event of violation of rights, such as intellectual and industrial property or any others whose existence could not be deduced by ARISTOPET, documentation proving the existence of the title or legal right infringed must be provided. Additionally, the personal data of the owner of the infringed right must be provided when it is a person other than the communicator, as well as the representation document to act on behalf of the former in these cases.
  • Express declaration that the information contained in the claim is accurate.

The receipt by ARISTOPET of the communication provided for in this clause will not imply, as provided in the LSSI, actual knowledge of the activities and/or contents indicated by the communicator.

  1. Data Protection and Cookies

Users who wish to know what data processing is carried out on the Website and the cookies used on it, can consult our Privacy Policy and our Cookie Policy.

  1. Validity and termination

ARISTOPET reserves the right to introduce modifications to this Legal Notice, publishing any change in the same way as this Legal Notice appears or through any type of communication to Users or other appropriate procedure.

Therefore, the temporary validity of this Legal Notice coincides with the time of its publication, until they are modified totally or partially, at which time the modified Legal Notice will become effective. Consequently, the User must carefully read this Legal Notice each time they access the Portal.

ARISTOPET may terminate, suspend or interrupt, at any time without prior notice, access to this Portal or to any of the services provided through it (ARISTOGANG, ARISTOSHOP, etc.), without the User being able to demand any compensation. After such termination, the prohibitions on the use of the content set forth above in this Legal Notice will remain in force.
